These Terms and Conditions (the “Terms”) govern your access to and use of getfrills.com, including the Frills online store and any related checkout, customer-account, and digital-download features (collectively, the “Website”). The Website is operated by Frills (“Frills,” “Company,” “we,” “us,” or “our”).
By visiting the Website, creating an account, placing an order, downloading a product, or otherwise using the Website, you agree to these Terms. If you do not agree, do not use the Website or purchase any product.
Frills sells digital image products through one-time purchases. Frills does not currently offer a subscription or recurring membership. Many images sold through the Website are created using artificial-intelligence tools and may also include human selection, editing, retouching, compositing, color work, or other post-production. Please review these Terms and the Image License Agreement before purchasing.
1. Definitions

“Customer,” “you,” or “your” means the individual or legal entity that accesses the Website or purchases a Product.

“Product” means a digital photo set, image pack, Mega Pack, mockup-ready image set, or other digital product offered for individual purchase through the Website.

“Product Page” means the page describing a Product, including its contents, price, preview images, file specifications, and available license options.

“Image” means an individual visual file included in a Product.

“Photo Set” or “Image Pack” means a curated group of Images generally organized around a cohesive subject, model, product, campaign, theme, or aesthetic.

“Mega Pack” means a larger curated group of Images that may include multiple subjects, styles, themes, or potential uses.

“License” means the limited right to use a purchased Product under the Image License Agreement and the license option selected at checkout.
2. Eligibility and customer accounts
2.1 Age and authority
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Website or place an order. If you purchase on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
2.2 Account information
If you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorization.
2.3 Account restrictions
You may not impersonate another person, provide false information, use the Website for unlawful activity, interfere with Website security, or attempt to gain unauthorized access to another account, Product, file, or system.
We may suspend or terminate an account when reasonably necessary to address fraud, payment disputes, security risks, unlawful activity, or a material violation of these Terms or the Image License Agreement.
3. Products and one-time purchases
3.1 No subscription
Products are sold individually as one-time purchases. A purchase does not create a subscription, recurring payment obligation, membership, or right to access the entire Frills catalog. You receive only the Product and License identified in your order confirmation.
3.2 Product descriptions and previews
We aim to describe each Product accurately. Product previews may be resized, cropped, watermarked, compressed, displayed in mockups, or shown on screens whose color settings differ from yours. Before purchasing, review the Product Page for the number and type of files, dimensions, format, resolution, license option, and any product-specific limitations.
Because Products are digital and may contain intentional grain, texture, stylization, or other creative effects, such characteristics are not defects when reasonably visible in the preview or disclosed on the Product Page.
3.3 Availability and corrections
We may add, revise, limit, or discontinue Products at any time. We may correct typographical errors, inaccurate descriptions, pricing mistakes, or availability errors. If a material error affects an order you already placed, we may contact you to confirm a correction, provide an appropriate substitute, or cancel and refund the affected order.
4. Prices, payment, and taxes
4.1 Prices
Prices are shown on the Website and may change at any time. A price change will not affect an order already completed, except when the displayed price resulted from an obvious error.
Unless stated otherwise, prices are listed in U.S. dollars. Your bank, card issuer, payment provider, or local jurisdiction may impose currency-conversion fees, transaction fees, or taxes for which you are responsible.
4.2 Payment authorization
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges for your order, including taxes and fees shown at checkout. Orders are not complete until payment is successfully processed.
Payments may be processed by Shopify or another third-party payment provider. We do not control, and are not responsible for, a payment provider’s separate services, security practices, availability, or terms.
4.3 Taxes
Applicable sales, use, value-added, or similar taxes may be calculated and collected at checkout. You remain responsible for taxes or duties that a taxing authority requires you to pay and that were not collected at checkout.
4.4 Fraud prevention
We may delay, decline, cancel, or refund an order when reasonably necessary to verify payment information, prevent fraud, comply with law, correct an error, or protect the Website or other customers.
5. Digital delivery and customer responsibilities
5.1 Delivery
Products are delivered electronically through a download page, email, customer account, or another method identified at checkout. Delivery times may vary because of payment review, technical issues, file size, or circumstances outside our reasonable control.
5.2 Download access
You are responsible for providing a valid email address, checking spam or promotional folders, and ensuring your device and software can open the listed file formats. If you do not receive access after a completed purchase, contact hello@getfrills.com with your order information.
5.3 Backups
Download links may expire, change, or become unavailable. After downloading a Product, you are responsible for securely storing and backing up your files. We do not guarantee permanent cloud storage, indefinite re-download access, or continued availability of a discontinued Product.
5.4 No physical shipment
Unless a Product Page expressly states otherwise, all Products are digital. No physical item will be mailed or shipped.
6. Refunds, cancellations, and chargebacks
6.1 Digital-product sales
Because Products are delivered digitally and cannot be returned in the same manner as physical goods, purchases are generally final and non-refundable once download access has been provided, except where required by law or stated in our Refund Policy.
6.2 Order issues
If you receive the wrong files, a corrupted archive, a duplicate charge, or a Product that materially differs from its description, contact hello@getfrills.com promptly. We may request your order number, screenshots, or other reasonable information needed to investigate. When appropriate, we may replace the files, restore download access, correct the issue, or issue a full or partial refund.
6.3 Cancellations
An order generally cannot be canceled after download access has been delivered. If access has not yet been provided, contact us promptly and we will determine whether cancellation remains possible.
6.4 Chargebacks
Before initiating a payment dispute or chargeback, please contact us so we can investigate and attempt to resolve the issue. Fraudulent or abusive chargebacks may result in suspension of download access or customer accounts, without limiting any rights available to us under law.
7. Image License Agreement
7.1 License controls use of Products
Your purchase does not transfer ownership of a Product or its source files. It grants a limited License under the Image License Agreement, which is incorporated into these Terms by reference.
The License applies only to the Product and license type identified in your order. Any Standard, Extended, team, client, resale, or other usage rights are determined by the Image License Agreement, the Product Page, and your order confirmation.
7.2 Order of priority
If the applicable documents conflict:

The Product Page and order confirmation control the Product’s contents, price, and license type purchased;

The Image License Agreement controls how Images and Product files may be used; and
-
These Terms control general Website access, orders, payment, delivery, disputes, and governing law.
7.3 Prohibited file access and redistribution
You may not obtain, copy, share, resell, redistribute, or make Product files available except as expressly allowed by the Image License Agreement. Purchasing one Product does not authorize access to any other Product or to the complete Frills catalog.
8. AI-generated content
8.1 Nature of the Images
Many Images are created using generative-AI tools and may be further selected, arranged, edited, retouched, composited, color-treated, or otherwise modified by a human. They should not be assumed to be traditional photographs or documentary records of real people, products, places, or events.
8.2 Review before use
AI-generated Images may contain visual artifacts, inaccuracies, anatomical irregularities, distorted text, invented products, or unintended similarities to real people, marks, or works. You are responsible for carefully reviewing each Image and determining whether it is appropriate for your intended use.
8.3 Likeness, endorsement, and factual claims
Unless expressly stated otherwise, people depicted in the Images are synthetic or illustrative and have not personally used, endorsed, or experienced any product, service, condition, or event. You may not use an Image in a manner that falsely identifies a depicted person as real or implies a real endorsement, testimonial, affiliation, diagnosis, or factual event.
8.4 Copyright and similarity limitations
The copyright status of AI-generated material varies by jurisdiction and may depend on the level of human authorship involved. We do not promise that every element of an Image is independently copyrightable, registrable, unique, exclusive, or free from all similarity to third-party content.
Your rights arise from the contractual License accompanying your purchase, not from an assignment of copyright in unprotectable material. You are responsible for obtaining additional clearance appropriate to high-risk uses, including prominent advertising, political communications, regulated industries, or uses involving recognizable people, brands, trade dress, or public figures.
8.5 Disclosure requirements
Laws, advertising rules, industry standards, or platform policies may require disclosure that content is AI-generated or digitally altered. You are responsible for determining and satisfying any disclosure requirement applicable to your use.
9. Website content and Frills intellectual property
The Website and its contents—including the Frills name, branding, layout, copy, product descriptions, graphics, previews, watermarks, collections, curation, selection, arrangement, and other original material—are owned by or licensed to Frills and are protected to the extent available under applicable law.
Except for the limited rights necessary to browse the Website and the License granted for purchased Products, no right, title, or interest is transferred to you. You may not copy, scrape, reproduce, frame, publish, reverse engineer, or commercially exploit Website content without our prior written permission.
The purchase and use of Product files are governed separately by the Image License Agreement.
10. Copyright and intellectual-property complaints
If you believe content available through the Website infringes your copyright or other intellectual-property rights, email dmca@getfrills.com with:

Identification of the work or right you believe has been infringed;

Identification and location of the allegedly infringing material;

Your name and contact information;

A statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law;

A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act for the rights owner; and
-
Your physical or electronic signature.
We may request additional information, remove or restrict access to disputed material, notify the party that supplied it, or take other action we reasonably consider appropriate. Knowingly submitting a materially false complaint may result in legal liability.
11. Acceptable use of the Website
You agree not to:

Use the Website or a Product in violation of law, these Terms, or the Image License Agreement;

Circumvent payment, access, download, watermark, security, or usage controls;

Use bots, scraping tools, or automated means to copy Website content, collect Product files, or burden Website systems;

Upload or transmit malware, harmful code, or material that interferes with Website operation;

Attempt to discover or exploit vulnerabilities or gain unauthorized access to accounts, files, or systems;

Use Website content to train, validate, fine-tune, or build a machine-learning or generative-AI system without our written permission;

Engage in fraud, impersonation, abusive chargebacks, or deceptive conduct; or
-
Use the Website in a way that infringes, misappropriates, or violates another person’s rights.
12. Third-party services and links
The Website may rely on or link to services operated by Shopify, payment processors, email providers, download-delivery providers, analytics providers, social-media platforms, or other third parties. Those services may be governed by separate terms and privacy policies.
We do not control and are not responsible for third-party websites, services, content, security, availability, or actions. A link or integration does not necessarily mean that Frills endorses the third party.
13. Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you acknowledge that you have reviewed the Privacy Policy.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FRILLS DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUALITY, UNIQUENESS, EXCLUSIVITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.
WITHOUT LIMITING THE FOREGOING, FRILLS DOES NOT WARRANT THAT:

THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS;

EVERY PRODUCT WILL MEET YOUR PARTICULAR CREATIVE, TECHNICAL, COMMERCIAL, OR LEGAL REQUIREMENTS;
-
AN IMAGE WILL BE COPYRIGHTABLE, REGISTRABLE, UNIQUE, OR FREE FROM ALL SIMILARITY TO OTHER CONTENT;

AN IMAGE WILL BE SUITABLE FOR A PARTICULAR PLATFORM, INDUSTRY, AUDIENCE, OR JURISDICTION; OR
-
A DOWNLOAD LINK OR DISCONTINUED PRODUCT WILL REMAIN AVAILABLE INDEFINITELY.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FRILLS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, PRODUCTION COSTS, RECALL COSTS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE WEBSITE, A PRODUCT, THESE TERMS, OR YOUR USE OF AN IMAGE.
TO THE FULLEST EXTENT PERMITTED BY LAW, FRILLS’ TOTAL LIABILITY FOR A CLAIM ARISING FROM OR RELATED TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FRILLS FOR THE PRODUCT AND LICENSE GIVING RISE TO THE CLAIM. FOR A CLAIM NOT CONNECTED TO A SPECIFIC PURCHASE, FRILLS’ TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Frills and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from:

Your breach of these Terms or the Image License Agreement;

Your unlawful, unauthorized, misleading, or prohibited use of the Website or a Product;

Your End Use, advertising claim, representation, product, service, or content created using an Image;

Your infringement, misappropriation, or violation of another person’s rights; or
-
Conduct by any person who accesses the Website or Product files through your account or in violation of your License.
17. Changes to the Website and these Terms
We may update the Website, Products, policies, and these Terms from time to time. The version posted when you place an order governs that transaction, except that updated security, safety, and legal-compliance requirements may apply when reasonably necessary or required by law.
If we make a material change affecting ongoing use of the Website, we may provide notice by posting the revised Terms, updating the “Last updated” date, displaying a Website notice, or sending an email when appropriate. Your continued use after the revised Terms take effect constitutes acceptance of the changes.
18. Governing law and dispute resolution
18.1 Governing law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
18.2 Informal resolution
Before filing a formal claim, you and Frills agree to make a good-faith effort to resolve the dispute by written notice. The notice must describe the dispute and requested relief and be sent to hello@getfrills.com. If the dispute is not resolved within 30 days after receipt of the notice, either party may proceed as permitted below.
18.3 Binding arbitration and class-action waiver
Except for disputes eligible for small-claims court and requests for temporary or injunctive relief concerning intellectual property, unauthorized access, or misuse of Product files, any dispute arising from or relating to these Terms, the Website, or a Product will be resolved by individual binding arbitration administered by the American Arbitration Association under the rules applicable to the dispute.
Arbitration will take place in Montgomery County, Alabama, unless the parties agree to remote proceedings or another location. The arbitrator may award any relief available in an individual action. You and Frills waive the right to a jury trial and agree that claims may be brought only on an individual basis, not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding.
If applicable law prevents enforcement of a portion of this Section, that portion will be severed to the minimum extent necessary, and the remaining provisions will continue in effect.
19. Termination
You may stop using the Website at any time. We may suspend or terminate access when reasonably necessary because of fraud, security concerns, legal requirements, nonpayment, or a material breach of these Terms or the Image License Agreement.
Termination of Website access does not cancel payment obligations or restore rights lost because of a License breach. A properly purchased License otherwise remains in effect as provided in the Image License Agreement.
20. General terms

Entire agreement. These Terms, the Privacy Policy, the Image License Agreement, the applicable Product Page, the order confirmation, and any policy expressly incorporated into them form the complete agreement governing your use of the Website and purchase of Products.

Severability. If a provision is found unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

Waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, sale of assets, reorganization, or other lawful business transfer.

Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control, including outages, cyberattacks, natural disasters, labor disputes, governmental actions, or failures of third-party service providers.

Electronic communications. You consent to receive transaction-related notices electronically, including by email or through the Website.

Headings. Section headings are for convenience only and do not affect interpretation.

Survival. Provisions that by their nature should survive termination—including payment, licensing restrictions, intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions—will survive.
